1. The Service

Chuply Ops ("the Service", "Platform") is a cloud-based field service management platform operated by Chuply (Pty) Ltd ("Chuply", "we", "our", "us"). The Service allows businesses to manage quotations, work cards, invoices, stock, field personnel, and related operations.

These Terms of Service ("Terms") govern your access to and use of the Service. By creating an account you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Accounts and Access

3. Subscription and Billing

The Service is offered on a subscription basis. Pricing is displayed at the time of sign-up and on our pricing pages. Subscriptions are billed monthly in South African Rand (ZAR). Prices are subject to change with 30 days' written notice.

A 14-day free trial is available for new accounts. No payment information is required during the trial period. At the end of the trial, continued use requires a paid subscription.

Failure to pay may result in suspension of your account. We reserve the right to terminate accounts that remain unpaid for more than 30 days after the due date.

You retain full ownership of all data you upload or create within the Service ("Customer Data"). You grant Chuply a limited licence to store, process, and transmit Customer Data solely for the purpose of providing the Service.

You are responsible for ensuring that your use of the Service — including collection and storage of your own clients' personal information — complies with the Protection of Personal Information Act 4 of 2013 ("POPIA") and any other applicable South African law.

We will not sell, share, or disclose your Customer Data to third parties except as necessary to provide the Service (e.g. cloud infrastructure providers), as required by law, or with your explicit consent.

6. Chuply Support Access

Authorised Chuply support staff may access your organisation's account information for the purpose of providing technical support, diagnosing issues, and maintaining the platform. This is a necessary component of delivering the Service.

All support-related access to your personal data is subject to our Privacy Policy and is logged in accordance with POPIA requirements. You may grant or revoke enhanced support access at any time from your account Settings.

Chuply staff will never access your data outside of a legitimate support, operational, or legal requirement.

7. Data Retention and Deletion

Your Customer Data is retained for the duration of your active subscription. Upon cancellation, data is retained for 30 days to allow for reactivation or export. After this period, data is permanently deleted. Certain data may be retained longer where required by South African law (e.g. financial records for tax purposes).

8. Availability and Uptime

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance, updates, and circumstances beyond our control may cause temporary unavailability. We will provide reasonable notice of planned downtime where possible.

9. Intellectual Property

The Service, including its design, code, features, and branding, is the intellectual property of Chuply (Pty) Ltd. You may not copy, reproduce, or use any element of the Service without our written permission, except as permitted by these Terms.

10. Limitation of Liability

To the maximum extent permitted by South African law, Chuply shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities. Our total liability to you shall not exceed the amount you paid for the Service in the three months preceding the claim.

11. Termination

Either party may terminate these Terms at any time. You may cancel your subscription from within your account settings. Chuply may suspend or terminate your account if you violate these Terms, fail to pay, or if we discontinue the Service, with reasonable notice where possible.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you by email and by displaying a notice within the Service at least 14 days before any material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.
